with Iron Man and The Incredible Hulk ruling the summer (along with a little non-Marvel movie called The Dark Knight), which had a combined budget/domestic gross of USD 290M/452M, Punisher: War Zone was probably released at this time with low expectations (why even release the movie eh?), and thus got the piddling $4M opening it deserved . slow economy, bleak holidays (despite what Black Friday sales might tell you) - people stayed home or just watched non-violent fare like Four Christmases. it could still creep up and break even its USD35M budget.
now, if they released this at a time when there's a real life crime spree (like that Beltway sniper attacks or organized mob hits), this could have been a big summer movie ... or the national mood is not really conducive to seeing body bags at this time.
